By using FogSwap's services, you agree to these Terms of Service. Please read them carefully - they govern your use of our cross-chain cryptocurrency services and protect both you and us.

Important: If you don't agree with any part of these terms, please don't use our services.

What We Do​

FogSwap is a non-custodial cross-chain aggregator that connects you to liquidity across multiple exchanges and blockchains. We provide routing and privacy features for cryptocurrency swaps without ever holding your funds.

What We Don't Do​

  • We don't hold your funds: All transactions occur directly with our exchange partners
  • We don't provide investment advice: Our service is purely transactional
  • We don't guarantee prices: Cryptocurrency markets are volatile and prices change constantly
  • We don't control blockchains: We can't reverse blockchain transactions

🔐 Your Responsibilities​

Eligibility Requirements​

To use FogSwap, you must:

  • Be at least 18 years old
  • Have legal capacity to enter into this agreement
  • Not be located in a restricted jurisdiction
  • Comply with all applicable laws in your jurisdiction
  • Not use our services for any illegal activities

Account Security​

  • Protect your wallet: Keep your private keys and passwords secure
  • Verify addresses: Always double-check wallet addresses before sending funds
  • Use personal wallets: Don't send from exchange accounts or smart contracts
  • Save your Order ID: Keep this for transaction tracking and support

Prohibited Activities​

You may not use FogSwap to:

  • Violate any laws or regulations
  • Engage in money laundering or terrorist financing
  • Process proceeds from illegal activities
  • Circumvent economic sanctions
  • Harass our team or other users
  • Attempt to manipulate or exploit our services

💱 How Transactions Work​

Transaction Process​

  1. Get Quote: We show you available routes and pricing
  2. Generate Address: We create a unique deposit address for your transaction
  3. Send Funds: You send cryptocurrency to the deposit address
  4. Process Swap: Our partner exchanges handle the actual swap
  5. Receive Tokens: You receive the swapped tokens in your destination wallet

Important Transaction Rules​

Deposit Addresses

  • Each deposit address can only be used once
  • Addresses expire after 24 hours for security
  • Don't reuse old deposit addresses

Supported Amounts

  • Stay within ±5% of the quoted amount for best results
  • Very small or very large deviations may cause processing issues
  • Minimum amounts vary by token and network

Processing Times

  • Standard swaps: 3-5 minutes typically
  • Private swaps: 20-40 minutes typically
  • Network congestion may cause delays
No Guarantees

We cannot guarantee transaction completion times, final amounts received, or prevent blockchain network issues. Cryptocurrency transactions involve inherent risks.

🤝 Exchange Partners​

Partner Selection​

We carefully select non-custodial exchange partners based on:

  • Security and compliance standards
  • Liquidity availability
  • Technical reliability
  • Regulatory standing

Partner Responsibilities​

Our exchange partners are responsible for:

  • Processing the actual cryptocurrency swaps
  • AML and compliance screening (including KYC when required)
  • Maintaining transaction records for their portion
  • Customer funds during processing
  • Compliance with their jurisdictional requirements

Partner Compliance Requirements​

Important: Some of our exchange partners may require additional compliance measures based on:

  • Transaction amounts
  • Token types being swapped
  • Source and destination jurisdictions
  • Partner-specific risk assessments
  • Regulatory requirements in their jurisdiction

What This Means for You

  • Transactions may be delayed for additional screening
  • Some swaps may require identity verification (KYC) by the exchange partner
  • Large transactions may trigger enhanced due diligence
  • Certain token pairs may have additional restrictions

FogSwap's Role in Partner Compliance

  • We select partners with appropriate compliance standards
  • We cannot override partner compliance requirements
  • We provide transparency about potential delays or requirements
  • We assist with communication between you and partners when needed
AML Compliance

All our exchange partners maintain robust AML/compliance programs. While FogSwap doesn't require KYC, individual partners may implement their own requirements based on their risk assessments and regulatory obligations.

We are responsible for:

  • Routing optimization and address generation
  • Platform security and uptime
  • Customer support for FogSwap-related issues
  • Compliance with our legal obligations

Regulatory Adherence​

FogSwap operates within applicable legal frameworks and:

  • Implements required compliance measures
  • Cooperates with legitimate law enforcement requests
  • Maintains necessary records for regulatory purposes
  • Blocks access from sanctioned regions

Geographic Restrictions​

Our services may not be available in all jurisdictions. We actively block access from:

  • OFAC-sanctioned countries
  • Jurisdictions where our services are prohibited
  • Locations with conflicting legal requirements

User Compliance​

You are responsible for:

  • Complying with laws in your jurisdiction
  • Understanding tax implications of your transactions
  • Ensuring your cryptocurrency sources are legitimate
  • Meeting any local regulatory requirements

🛡️ Service Limitations​

Platform Availability​

  • Services may be unavailable due to maintenance, updates, or technical issues
  • We may modify or discontinue features at any time
  • Network congestion or partner issues may affect service quality

Support Limitations​

  • Support is provided for FogSwap platform issues only
  • We cannot recover funds sent to wrong addresses or with wrong tokens
  • We cannot reverse completed blockchain transactions
  • Response times may vary based on issue complexity

Liability Limitations​

FogSwap's liability is limited to direct damages up to $100 USD. We are not liable for:

  • Indirect, consequential, or punitive damages
  • Loss of profits or business opportunities
  • Issues caused by third-party services or blockchain networks
  • User errors or violations of these terms

🔒 Privacy & Data​

Data Collection​

We collect minimal data necessary for service provision and compliance:

  • Transaction details for processing and support
  • Basic technical information for security
  • Communication records for support purposes

Data Retention​

  • Transaction data is automatically deleted after 72 hours
  • Support case data may be retained until issue resolution
  • Users can request immediate data deletion during transactions

Support First​

Before escalating any dispute:

  1. Contact our support team with your Order ID
  2. Provide clear details about your issue

  • Individual basis only (no class actions)
